PIRELLI GIFT STORE (“PROMOTION”)

TERMS & CONDITIONS

  1. The Promoter is Pirelli Tyres Australia Pty Ltd, ABN 63 001 784 014, Level 10 37 York Street, Sydney NSW 2000 referred to herein as ‘Pirelli’ (“Promoter“).
  2. The Promotion is administered by TLC Marketing Worldwide Asia Pacific Pty Ltd, ABN 75 622 802 180, Level 13, 333 George Street, Sydney NSW, 2000, Australia (“TLC”). All correspondence regarding this Promotion should be directed to this address.
  3. Instructions on how to enter and claim form part of these terms and conditions.
  4. Participation in this Promotion is deemed acceptance of these terms and conditions.

CONDITIONS OF ENTRY

  1. This Promotion is only open to Australian residents aged 18 years and over.

Employees (and their immediate families) of TLC and the Promoter and agencies associated with this Promotion are ineligible to participate in this Promotion. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1stcousin.

KEY DATES

  1. The Promotion is open for Qualifying Purchases (defined below) made between 12.01am AEDT on 01/03/2019 and 11.59pm on 30/04/2019 (“Purchase Period”).
  2. The Registration Period –  Registrations must be made by uploading the proof of purchase on the retailers website – opens 12.01am on 01/03/2019 and closes 11.59pm 15/5/2019 (“Registration Period”) A Pirelli Gift Store code will be sent to customer within 14 days.
  3. The Claim Period – The Pirelli Gift Store code must be used to claim the gift by 11.59pm on 30/6/2019 (“Claim Period”).
  4. All Rewards must be redeemed by 31/8/2020 or unless specified otherwise in the Reward Specific terms listed in Appendix 1 (“Redemption Period”).

HOW TO ENTER

  1. To be eligible to participate in the Promotion, entrants must:
    • Purchase four (4) Pirelli Cinturato or Scorpion tyres of 17” rim or above in one transaction from a Participating dealer (Available only at Bob Jane T-marts, JAX Tyres and selected Independent stores (“Participating dealer”) during the Purchase Period (“Qualifying Purchase”). Entrants must retain their purchase receipt(s) for all entries. In the event a purchase receipt is not automatically provided to them it is the entrant’s responsibility to request one.
    • Visit www.pirelli.com.au to locate your nearest Participating dealer.
  2. To register, entrants must then:
    1. During the Promotional Period purchase four (4) Pirelli Cinturato or Scorpion tyres of 17” rim or above in one transaction.  (“Eligible Product”)  This offer is available only on the Cinturato and Scorpion Range. The range includes Cinturato P1, Cinturato P6 and Cinturato P7, Scorpion ATR, Scorpion A/T+, Scorpion Verde, Scorpion Verde All Season, Scorpion STR, Scorpion Zero, Scorpion MTR and Scorpion MUD. This offer is only available whilst stocks last.
    2. Complete a registration Form (“Registration Form”) in accordance with these Terms. Claims can be submitted online only to the retailers website where the purchase of the four (4) Pirelli Cinturato or Scorpion tyres took place.
    3. Registrations to all retailers website must made by 11:59pm AEDT 15th May 2019 Registrations are deemed received at the time of receipt by the Promoter.
    1. After verifying your purchase, the retailer will then email the Eligible Claimant a Pirelli Gift Store Code within 14 days.
  3. To claim for the reward (“Eligible Claim”), an Eligible Claimant must:
    1. Visit www.pirelligiftstore.com.au and select a gift
    2. Fully complete the Claim Form using the Pirelli Gift Store Code provided by the retailer, enter in their first name, surname, email address and phone number by 30/6/2019.  
  4. Multiple claims permitted, subject to the following: (a) Qualified Customers may only claim one (1) Reward per Qualifying Purchase; (b) each claim must be submitted separately and in accordance with these terms and conditions; (c) only one (1) Pirelli Gift Store Code per claim is permitted; (d) the same Pirelli Gift Store Code cannot be used more than once; (e) unrecognised codes will be deemed invalid.
  5. Swapping of rewards is not permitted. Once the reward has been chosen it cannot be swapped for another reward.

OTHER GENERAL TERMS & CONDITIONS

  1. Qualified Customers must retain their original purchase receipt for all claims as proof of purchase. Failure to produce the proof of purchase when requested may, at the absolute discretion of the Promoter or TLC, result in invalidation of a Qualified Customer’s claim (and/or all claims submitted by the Qualified Customer) and forfeiture of any right to a Reward.
  2. If there is a dispute as to the identity of a Qualified Customer, TLC or the Promoter reserves the right, in their sole discretion, to determine the identity of the Qualified Customer.
  3. The Promoter or TLC reserve the right to request Qualified Customers to provide proof of identity in order to claim the Reward. Identification considered suitable for verification is at the discretion of TLC or the Promoter. In the event that a Qualified Customer cannot provide suitable proof, the Qualified Customer will forfeit the Reward in whole and no substitute will be offered.
  4. The Promoter and TLC’s decision in relation to all aspects of this Promotion is final and no correspondence will be entered into.
  5. Incomprehensible, indecipherable and incomplete entries / proof of purchase may at TLC’s discretion be deemed invalid and not eligible for Reward.
  6. The Reward is personal to each Qualified Customer and Child, and cannot be exchanged, transferred, shared or assigned in any manner. Rewards cannot be used or redeemed in conjunction with any other Promotion.
  7. Access to the promotion is available online only and therefore access to the internet is required to participate in this Promotion. Any cost associated with accessing the promotional website is the Qualified Customer’s sole responsibility and is dependent on the Internet service provider used by the Qualified Customer.
  8. The Promoter (including its directors, officers, employees and agents) and TLC reserve the right, at any time, to verify the validity of claims and the Qualified Customer (including a Qualified Customer’s identity, age and place of residence) and reserve the right, in their discretion, to disqualify any individuals who they have reason to believe has breached any of these terms and conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the Promotion. Errors and omissions may be accepted at the Promoter’s and TLC’s discretion. The Promoter’s and TLC’s legal rights to recover damages or other compensation in such circumstances are reserved.
  9. Failure by the Promoter or TLC to enforce any of their rights at any stage does not constitute a waiver of those rights. The Promoter’s and TLC’s legal rights to recover damages or other compensation arising as a result of such conduct are reserved.
  10. The Promoter (including its directors, officers, employees and agents), TLC, its respective agents, Reward providers and distributors are not liable for lost, stolen or damaged Rewards, and to the extent permitted by law do not make any contractual promise or representation regarding the quality and/or availability of the services offered and cannot be held liable for any resulting personal loss or damage.
  11. The Reward is subject to availability. If the Reward is unavailable, for whatever reason, TLC reserves the right to substitute the Reward for a Reward of equal or greater value and/or specification, subject to any written directions from a regulatory authority.
  12. The Promoter or TLC reserve the right to vary the terms of the Promotion at any time and to withdraw the Promotion without notice.
  13. In the event that for any reason whatsoever a Qualified Customer does not take or claim a Reward (or an element of a Reward) at or by the time stipulated by the Promoter or TLC, then that Reward (or that element of the Reward) will be forfeited by the Qualified Customer and cash will not be awarded in lieu of that Reward (or element of the Reward).
  14. Except for any liability that cannot be excluded by law, the Promoter (including its directors, officers, employees and agents), TLC and the Reward providers (including their respective officers, employees and agents) are not responsible for and exclude all liability (including for negligence) for: any personal injury, death or harm suffered by a Qualified Entrant or any Child or other person who redeems the Reward (and Qualified Entrant releases Promoter and TLC from any such liability – including on behalf of the Child and any other person who redeems the Reward); or any loss or damage (including loss of opportunity), whatsoever, whether direct, indirect, special or consequential, arising in any way out of:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s or TLC’s or Rewards provider’s control);
    2. any theft, unauthorised access or third party interference;
    3. any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter or TLC or Rewards provider) due to any reason beyond the reasonable control of the Promoter or TLC or Rewards provider;
    4. any variation in Reward value to that stated in these terms and conditions;
    5. any tax liability incurred by a Qualified Customer or claimant; or
    6. the use and/or taking of a Reward.
  15. Should a Qualified Customer’s contact details change during the Promotion, it is the Qualified Customer’s responsibility to notify TLC. A request to access or modify any information provided in claim/entry should be directed to TLC.
  16. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason, including by outside act, agent or event that is beyond the reasonable control of the Promoter and TLC, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter or TLC reserves the right, in their sole discretion, to the fullest extent permitted by law:
    1. to disqualify any Qualified Customer; or
    2. subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.
  17. The terms of the Reward are as stated in these terms & conditions and no other representations (written or oral) shall apply. Nothing in these terms affects any statutory rights a Qualified Customer may have including under the Australian Consumer Law.
  18. The entrants consent to the Promoter and TLC using and disclosing their personal information and that of their Child, such as their name, likeness, image and/or voice in the event they are a successful Qualified Customer (including photograph, film and/or recording of the same) in any media for an unlimited period and without remuneration for the purpose of promoting this Promotion (including any outcome) or any further Promotion, and promoting any products manufactured, distributed and/or supplied by the Promoter or TLC.
  19. Personal information (PI) is being collected by TLC and the Promoter in order to conduct this Promotion. For this purpose, TLC and the Promoter may disclose PI to third parties, including but not limited to their employees, agents, contractors, service providers, suppliers and, as required to under any applicable law, to regulatory authorities. Participation is conditional on a claimant providing TLC and the Promoter this PI. TLC will use and handle personal information as set out in its Privacy Policy, which can be viewed at http://www.tlcmarketing.com/uk/Legal#au. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at https://www.pirelli.com/tyres/en-au/privacy-policy.  Each Privacy Policy also contains information about how Qualified Customers may opt out, access, update or correct their PI, how Qualified Customers may complain about the treatment of their PI, and how those complaints will be dealt with, subject to the consent that a claimant provides above at clause 43 above. The Promoter and TLC may disclose personal information to entities outside of Australia (for a list of countries, see the Promoter’s or TLC’s Privacy Policies).

    1. The Unlimited Fun Pass Reward code gives the claimant access on the promotional website to claim an e-Voucher every day for 12 consecutive months.
    2. Each experience voucher entitles the customer to claim one (1) Free, 2 for 1, or discounted admission to the participating venue of their choice subject to the terms stated here.  For 2 for 1 offers the admission of equal or lower value will be given for free.
    3. eVouchers must be printed and surrendered or shown on a qualified  Customer’s mobile phone either via the link or a screen shot at the selected venue on the day to ensure the customer receives the Free, 2 for 1 or discounted experience selected. ID may be required when presenting the eVoucher as proof of identity. Photocopies of e-Vouchers will not be accepted.
    4. Customers can use the Annual Fun Pass reward code on the Promotional Website to claim an experience eVoucher every day for 12 consecutive months.  Limit of one (1) eVoucher per person, per venue, per day.
    5. eVouchers to each selected activity or attraction are valid for 30 days from date of issue
    6. Only one (1) eVoucher may be used per group per venue. Participating venues will not allow multiple members of a group to redeem their eVouchers at the same time. Selected venues reserve the right to limit the total number of eVouchers that may be redeemed on any given day. Please contact the venue in advance of redemption to avoid disappointment.
    7. eVouchers are valid for one (1) use at a participating venue until the expiry date printed on the eVoucher. Additional restrictions on validity, age and height restrictions may apply – please check with the chosen participating venue.
    8. eVouchers can only be used at the chosen venue (as printed on the Voucher).
    9. eVoucher must be presented at a participating venue and possession of an Voucher does not provide the voucher bearer to any preferential treatment.
    10. It is the responsibility of the customers to use their eVoucher by the specified expiry date. The eVoucher is issued with the understanding that it will not be extended or replaced.
    11. Use of eVoucher is subject to availability at participating venues and their use may be limited during public and school holidays and other peak periods.
    12. eVouchers cannot be used in conjunction with any other voucher or special offer.
    13. eVouchers are subject to the Terms and Conditions of the provider of the selected activity or attraction.
    14. The Promoter, TLC, its respective agents and distributors are not liable for lost, stolen or damaged eVouchers.
    15. The Promoter, TLC, its respective agents and distributors will not be responsible or liable to compensate the purchaser or other bearer, or accept any liability for any personal loss or injury occurring at the participating venue.
    16. The Promoter, TLC, its respective agents and distributors do not make any contractual promise or representation regarding the quality and/or availability of the services offered by the venues and cannot be held liable for any resulting personal loss or damage. Any statutory rights the customers may have remain unaffected.
    17. Any disputes between customers pertaining to the use of the eVouchers are strictly between the customers and the participating venue.
    18. The experiences are subject to promotional availability. The Promoter or TLC reserve the right to withdraw or substitute experiences and/or eVouchers with another offer of equal or greater value, for example, if a venue closes, a replacement eVoucher may be issued for another venue.
    19. All customers taking advantage of the 12 Month Fun Pass do so, on complete acceptance of these terms and conditions.

  1. $1,000 Travel Credits
    • When making a reservation on the Credit For Travel website, you will see the retail price reduced by the savings. You will pay the reduced price displayed to complete your reservation.
    • Your Travel Credit reward Code is valid for 12 months from date of issue or up until 31/8/2020 whichever is first.

    CONDITIONS ATTACHING TO THE REWARD:

    Your Credit For Travel code provides you specific dollar amounts of savings off of the retail pricing for hotels and other travel products and services (the “Products”) offered on https://euro.creditfortravel.com/ (“Website”). In order to use your savings dollars, you must activate it by entering the code provided on your welcome email. By using your savings dollars, you agree to abide by this Terms of Use policy (“Policy”). This Policy, which is also posted on the Website, may change from time to time. You also agree to abide by the posted terms and conditions for each Product offered on the Website (“Product Terms”). Product Terms may also appear on your purchase confirmations. Product Terms vary and are subject to change by Product providers.

    HOW IT WORKS:

    1. Follow the directions on your card or welcome email to activate your savings code. The face value of your code will be deposited to your account (“Savings Bank”).
    2. The dollar amount of savings off retail pricing is displayed on the Website with each Product offered (“Savings”). Savings are subject to change without notice. Only the Savings posted at the time a reservation is booked and paid for will be honoured.
    3. When making a reservation on the Website, you will see the retail price reduced by the Savings. You will pay the reduced price displayed to complete your reservation.
    4. After you book and pay for your reservation, the dollar amount of the savings will be deducted from your Savings Bank. The dollars remaining in your Savings Bank can be used for other reservations until your Savings Bank balance is zero.
    5. Once a reservation is booked and paid for, it cannot be changed or modified, but, it may be cancelled if permitted under the Product Terms. Cancelled reservations may incur a cancellation fee. Any Savings used for the cancelled reservation cannot be re-deposited into your Savings Bank.
    6. You can continue to use your Savings Bank to reduce the retail cost of reservations until your Savings Bank has been used leaving a zero balance or the expiration of your code(s) amount, whichever occurs first.
    7. For Customer Service regarding savings dollars or booked reservations, please log into the Website and click on “View Reservations” located in the “My Account” section, or use the form on the “Contact Us” page on https://euro.creditfortravel.com/

    GENERAL TERMS:

    1. Customers must be 18 years of age or older to register a code and use the Website.
    2. You are responsible to pay for any costs not included in the Product price such as government taxes and fees imposed by providers. You are also responsible for any expenses you incur while using the Products you purchased on the Website and for purchases made outside the Website, including but not limited to transportation, meals, gratuities, telephone calls, room service and incidentals.
    3. Savings codes have no value except when used in accordance with this Policy. Savings codes are not gift certificates, nor credit nor debit cards, or prepaid vacation vouchers.
    4. Savings codes have no cash surrender value, credit value or other implied value.
    5. Savings codes will not be replaced if lost, stolen, damaged or expired.
    6. You can give your savings code to friends or family prior to activation, but once activated, only the person on the account can use the savings
    7. Any suspected or actual abuse of the Policy or Product Terms may result in immediate deactivation of Customer’s savings passport(s) and savings bank without warning or notice, cancellation of any purchased Products, chargeback to Customers for fees and charges incurred by Credit For Travel or its suppliers due to Customer’s abuse.
    8. You who make use of the savings codes and the Products agree to indemnify and hold harmless Credit For Travel, its owners, affiliates, agents, contractors, assignees and designees, from any and all claims, liability and responsibility for damages, expenses, inconvenience, dissatisfaction, injury, accident, death or damage to any persons or property whatsoever, arising from or related to the use of the savings codes or Products. Credit For Travel makes no warranty of any kind with respect to the Products offered by provider. Credit For Travel shall not be liable or responsible for delays or cancellations due to weather or mechanical breakdowns, war, acts of God or any other matters beyond its reasonable control. Credit For Travel assumes no responsibility for any verbal or written representation about savings codes by any distributor, or third party other than what is expressly written in the Policy and Product Terms. If any conflict arises between this Policy and the Policy posted on the Website, the Website shall take precedence.
    9. Offer not valid where prohibited or restricted

  2. The Pirelli $300 Car Wash Pass gives you 2 car washes per month, for 14 months.

    • To request your 2 x Free Car Wash vouchers, you must visit www.pirelligiftstore.com.au, use your Monthly Car Wash code within the first 7 calendar days of the month, each month, to request your 2 x Car Wash vouchers An email will be sent to you with 2 x Free IMO Car wash vouchers.Failure to request the vouchers within the first 7 calendar days deem the request of that month invalid.
    • Each IMO car wash is awarded as an IMO car wash voucher embedded within the claim complete email sent to the Claimant (‘eVoucher’).
    • The Free IMO Car Wash voucher entitles the Claimant to one (1) Free attended machine wash and machine dry (basic) car wash from one of the IMO Car Wash locations listed on www.imocarwash.com/au.
    • In the event that there are no IMO car wash venues within a 45 minute drive from you, please contact our customer service team to request your Car Wash Voucher  at contact@pirelligiftstore.com.au
    • The eVoucher is valid for single use only.
    • This eVoucher is not valid for use in conjunction with any other offers.
    • This eVoucher has no cash value and is not for resale.
    • Surcharges apply to upgrades, add-ons or other specials.
    • eVouchers must be printed and surrendered at the venue on the day to ensure the customer receives the free car wash. ID may be required for presentation eVoucher as proof of identity.
    • Before visiting Claimants must check opening times and directions via www.imocarwash.com/au.
    • Any disputes between customers pertaining to the use of the eVouchers are strictly between the customers and the participating venue.
  1. $300 Harvey Norman Voucher
  2. $300 Voucher to use against a selection of products from Harvey Norman. The selection of products can be viewed online at www.pirelligiftstore.com.au The voucher is strictly for use on Pirelli Gift Store website only and cannot be used directly at Harvey Norman.

    • The product price displayed on www.pirelligiftstore.com.au are based on current market price at Harvey Norman.
    • Product is available for home delivery only and distribution to Australian addresses only. Pick-up from Harvey Norman store is not permitted. Delivery cost is additional to the product cost and will be displayed at purchase summary before customer confirm to order

    • The $300 will be deducted off the final price of products purchased.
    • Payment for the goods will be via bank transfer, details will be forwarded to the customer upon confirmation of purchase order  
    • Customers must pay for their goods within 30 days of selection of products Failure to make the payment within 30 days will void the purchase order and no new voucher will be issued.The Voucher is valid for single use only.
    • This Voucher is not valid for use in conjunction with any other offers.
    • This Voucher has no cash value and is not for resale.
    • Any disputes between customers pertaining to the use of the Vouchers are strictly between the customers and the participating venue.

  2. $300 Voucher to use against a selection of products from Drummond Golf. The selection of products can be viewed online at www.pirelligiftstore.com.au. The voucher is strictly for use on Pirelli Gift Store website only and cannot be used directly at Drummond Golf.

    • The product price displayed on www.pirelligiftstore.com.au are based on current market price at https://www.drummondgolf.com.au/
    • Product is available for in-store pick up or home delivery. For home delivery, some items incur an additional delivery cost of flat $20 and it is available for distribution to Australian addresses only. Customer will be asked to choose their preferred way of receiving the items prior to confirming the order. The $300 will be deducted off the final price of golfing products purchased.
    • Payment for the goods will be via bank transfer, details will be forwarded to the customer upon confirmation of purchase order
    • Customers must pay for their goods within 30 days of selection of products. Failure to make the payment within 30 days will void the purchase order and no new voucher will be issued.
    • The voucher is valid for single use only.
    • This voucher is not valid for use in conjunction with any other offers.
    • This voucher has no cash value and is not for resale.
    • Any disputes between customers pertaining to the products are strictly between the customers and Drummond Golf.

    • All ancillary costs or accessories are the responsibility of the claimant.
  1. 4 x Free Personal Training Session
  2. The Free Personal Training gift gives you one (1) Free Personal training session per month, for a consecutive of a total of four (4) months.

    • To request your Personal Training session, you must visit www.pirelligiftstore.com.au, use your Monthly Personal Training code within the first 7 calendar days of the month, each month, enter your postcode, select your preferred day of the week and timeslot for your Personal Training Session. Failure to request the session within the first 7 calendar days deem the request for that month invalid. You will receive an email with details for your Personal Training session for that month within 5 business days.
    • Each Personal training Session comprises of one (1) 45mins personal training session
    • The Free Personal training session cannot be used in conjunction with any other voucher or special offer. Personal training sessions cannot be transferred or sold.
    • TLC, its respective agents and distributors will not be responsible or liable to compensate a claimant or other bearer, or accept any liability for any personal loss or injury occurring at the Personal Training session.
    • Any disputes between claimants pertaining to the use of Personal Training Session are strictly between the claimant and the Personal Trainer.
    • TLC, its respective agents and distributors do not make any contractual promise or representation regarding the quality and/or availability of the services offered by the venues and cannot be held liable for any resulting personal loss or damage
    • Additional restrictions on use, validity, age, height restrictions and number of personal training session used per group may apply – please check with the chosen participating venue.
    • Use of personal training sessions are subject to availability at participating venues and their use may be limited during public and school holidays and other peak periods.
    • The claimant: (a) must attend, undergo and pass any appropriate training, briefings, safety demonstrations, required medical tests and other requirements of the Promoter and a Personal training session prize supplier as determined by them in their absolute discretion; (b) must declare to the Promoter or a Personal training session prize supplier (as applicable) any health-related issues that may affect his/her safe participation in any part of a Personal training session prize and obtain a written clearance from their doctor in this respect; and (c) must not have any heart condition or history thereof, or other medical conditions that would make it dangerous to participate in any part of a Personal training session prize. The Promoter and a Personal training session prize supplier in their absolute discretion: (a) reserve the right to refuse to allow a winner to take part in any or all aspects of a Personal training session prize if they reasonably believe the winner poses a safety risk or for any other reason; and (b) may cancel the relevant component of a Personal training session prize if the conditions are deemed dangerous. No compensation will be payable if a winner is unable to use any element of a Personal training session as stated for whatever reason, including refusal of participation in certain activities for health, age, behaviour or safety reasons.

    • The $300 Holiday Cash reward will be redeemable against a holiday (flights and accommodation) for 2 people with a 5 night minimum stay.

Once a claim has been submitted the claimant will receive an email to their nominated email address with details of how to book and use the $300 Holiday Cash reward.     The Free Movies for 14 Months offer gives the claimant one (1) Free cinema voucher per month, for 14 months.

    • To request your Free Cinema vouchers, you must visit www.pirelligiftstore.com.au, use your Monthly Cinema code within the first 7 calendar days of the month, each month, to request your Cinema vouchers. An email will be sent to you with one Free Cinema voucher in 5 business days.  Failure to request the vouchers within the first 7 calendar days deem the request of that month invalid.

    One Free Standard cinema tickets
